Terms of Service

Subject to these Terms, Eyeban grants you a limited, non-exclusive, non-transferable right to access and use the Service for your own software development work.

The Service may include AI-assisted coding features that suggest code, edits, explanations, or other outputs (“Suggestions”) based on prompts, files, and other information you provide (“Inputs”). Inputs and Suggestions together are “Content.”

You may not: reverse engineer the Service except where allowed by law; resell or sublicense the Service; remove proprietary notices; use the Service to attack, scrape, or disrupt Eyeban infrastructure; use the Service to develop a competing model by extracting Outputs at scale; or use the Service in violation of applicable law.

You retain your rights in Inputs you submit. To the extent Eyeban obtains any rights in Suggestions generated for you, Eyeban assigns those rights to you, subject to these Terms and the rights of third-party model providers.

Suggestions are generated by machine learning systems and may be incorrect, incomplete, insecure, or similar to Suggestions given to other users. You are responsible for reviewing, testing, and deciding whether to use any Suggestion. Do not treat Suggestions as legal, security, or compliance advice.

Eyeban will not use your Content to train AI models, and will not allow third parties to train on your Content, unless you explicitly opt in to training where such a control is offered in the product. See the AI and data use policy for details on what is sent to model providers to generate Suggestions.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use paid features of the Service. By using the Service, you represent that you meet this requirement and that your use complies with the laws that apply to you.

Some features require an account. You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly at hello@eyeban.ir if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms, create risk for other users, or remain unpaid where fees apply.

Certain plans, credits, or wallet top-ups may require payment. Prices, limits, and billing periods will be shown before you pay. Unless required by law, fees are generally non-refundable once the paid period or credit package has been delivered.

Where Iranian payment rails are offered, checkout may be processed through Zarinpal or another payment provider we designate. Their terms and privacy practices apply to payment processing. You authorize us and the payment provider to charge the selected method for recurring subscriptions until you cancel in accordance with the cancellation instructions in your account or by contacting us.

We may change prices with reasonable notice for future billing periods. Taxes may apply based on your location.

Eyeban and its licensors own the Service, including software, branding, documentation, and site content, excluding your Inputs and third-party open-source components distributed under their own licenses.

If you send feedback or suggestions about the Service, you grant Eyeban a worldwide, royalty-free license to use that feedback without obligation to you.

The Service may call third-party model providers, hosting providers, analytics (if enabled), or payment processors to operate. Optional integrations you enable are subject to those providers’ terms. Eyeban is not responsible for third-party services you choose to connect.

We may send transactional messages about your account, security, and billing. We may also send product updates. You can opt out of non-essential marketing emails using the unsubscribe link or by contacting us.

We may modify features, limits, or availability of the Service. We may update these Terms by posting a revised version with a new “Last updated” date. Material changes will be highlighted when practical. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the Service.

You may stop using the Service at any time and may request account closure by contacting hello@eyeban.ir. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, limitation of liability, and governing law) will survive termination.

THE SERVICE AND SUGGESTIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EYEBAN DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Beta or early-access features are provided for evaluation, may change or be withdrawn, and may be less reliable than generally available features.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EYEBAN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR CONTENT.

EYEBAN’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO EYEBAN FOR THE SERVICE IN THE SIX MONTHS BEFORE THE CLAIM, OR (B) ONE MILLION IRANIAN RIALS (OR THE EQUIVALENT IF WE BILL IN ANOTHER CURRENCY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MINIMUM PERMITTED BY LAW.

These Terms are governed by the laws of the Islamic Republic of Iran, without regard to conflict-of-law rules. Courts located in Tehran shall have jurisdiction over disputes arising from these Terms, unless mandatory consumer protections in your place of residence require otherwise.
